Ahead of a looming deadline for Israel and Hamas to respond to war crimes charges in the UN-sponsored Goldstone report, Human Rights Watch (HRW) hit back today at a claim made by Hamas earlier this week that its fighters did not commit war crimes in its three-week war with Israel last winter. Instead, said Hamas, its fighters struck civilian areas in Israel “by mistake” when launching rockets at the country’s military installations.

The United States and Egypt, along with France, are planning a joint move to restart Israeli-Palestinian talks on the basis of the June 4, 1967, borders, territorial exchanges and a complete freeze of construction beyond the Green Line, including East Jerusalem. The freeze would not be announced publicly. Egypt's foreign minister, Ahmed Aboul Gheit, said in an extensive interview with the Arabic daily Asharq Al-Awsat that "once they realized their earlier approach had failed, the Americans see themselves forced to change direction."

Members of the UN Committee on the Inalienable Rights of the Palestinian People discussed the status of Palestinians and the ongoing Israeli occupation on Monday as the UN observed the International Day of Solidarity with the Palestinian People. Secretary-General Ban Ki-moon expressed his concerns over the failure to resume peace talks based on a two state solution for over a year and further called on Israel and Palestinian authorities to conduct immediate investigations into allegations of grave human rights violations committed in Gaza during Israel’s Operation Cast Led last year.

With US diplomacy seemingly going nowhere, Palestinians are exploring desperate and at best symbolic measures to press a demand for a state that even firm believers in peace among them fear may never emerge. Appeals to the United Nations and European Union to consider recognizing a state that Israel says it cannot accept on the Palestinians’ terms look unlikely to break the deadlock.

If both Israel and Hamas condemn the proposal of a UN declaration of independent Palestinian state in the West Bank and Gaza, as they have, it suggests it must be the right idea. The Palestinian Authority has come up with it because nothing is happening to the peace process. It is their way of forcing it back onto the international agenda.
